Johnson & Johnson has asked a federal judge to handle the multiple lawsuits against them regarding the safety of their baby powder and other talcum powder products.
Change of Setting
Johnson & Johnson are asking for a federal judge based in Delaware to take the helm, rather than each case being heard at the state level. The company is also asking to take advantage of bankruptcy protections that have been given to their talc supplier Imerys Talc SA according to an article from Bloomberg.
Due to the legal onslaught that Johnson & Johnson has faced over claims that their baby powder contains asbestos and as a result has caused thousands of individuals, primarily women, to be diagnosed with mesothelioma and ovarian cancer. Imerys Talc SA was forced to file for Chapter 11 bankruptcy due to mounting legal costs over verdicts being awarded to the plaintiffs (read more about the filing here).
An Unlikely Scenario
A Florida based lawyer who has worked on mass tort cases that have gone the way of bankruptcy commented that it seemed unlikely Delaware would be willing to take on so many cases by themselves.
