Vehicle accidents can be a scary time that can cause stress and anxiety along with potential physical injuries. Many people are not sure where to start if they have been involved in an accident.

If you have been in a truck accident, and have suffered any kind of physical or mental injury due to another driver’s negligence, you need to call for truck accident legal help immediately.

Statute of Limitations for a Truck Accident Claim

In Denver, Colorado, the statute of limitation to claim compensation for a truck accident is 3 years from the date of the accident.

It is important to understand that if you file a claim after a certain time, it will most likely be tossed out and barred from ever getting any compensation.

What to Do Immediately After a Truck Accident?

While truck accidents can be more horrifying and damaging than car accidents or automobile accidents, it is not uncommon for the victims to be left stunned and unsure about the next step.

Once you have made sure you are alright and capable of moving around, follow these steps to get truck accident legal help:

  • Report the Case: If the accident was due to another driver’s negligence, and has caused any type of damage, injury, or death, by the law of Colorado, you must report it immediately to the police. You can either do this by calling the police to the accident location or going to the police station yourself.Note: Don’t forget to ask for a copy of the report.
  • Ask for Treatment: Even if the injuries seem minor, make sure you get the necessary medical treatment immediately. The doctors might perform certain examinations that may reveal or rule out inner injuries.
  • Crash Site Information: Since you might have to report the case yourself, it is always a good idea to note or take a photo of the truck driver’s name, number plate, insurance information, etc. Also ask for the contact and name of the truck driver’s employer, if any.
  • Look for Witnesses: Witness testimony can go a long way in proving and claiming the necessary compensation in case anything goes haywire. Look for people around, ask for their names and contact numbers, and seek their consent to give a brief statement.
  • Documented Information: If you have your cell phone with you, it is a good idea to take photos of the evidence and the accident scene, your injuries, number plates, etc. until the police arrive.
  • Avoid talking to the Insurance Companies: In case the insurance people of the offender want to talk to you, refrain from saying anything. They might use anything you say to their advantage and may lure you into making adjustments or accepting much less compensation for your injuries and damages.

This is also where a truck accident legal help specialist can come to your rescue.

Why Hire a Truck Accident Lawyer?

The best part about hiring legal help after a truck accident in Colorado is that you need not pay anything until you receive your claim.

Other than that, there are many reasons why hiring a truck accident lawyer Denver CO might be the best idea moving forward:

  • Professional Investigators: A professional law firm houses an investigation team that can collect the necessary information required for legal proceedings from the site of the accident. Not everyone is in their right state of mind immediately post-accident and the trauma may be likely to impact their effective thinking. This is where an accident lawyer can come into play.
  • Necessary Paperwork: While you tend to your wounds and mental trauma, you have someone to manage the paperwork for you. Legal help can also set free you from all the hustle and bustle of negotiating with the insurance companies, policemen, etc.
  • Litigating the Case: In case you do not get what you deserve through an initial effort, a professional accident lawyer can help you file a case and drag the offender to court if required. Call your Denver personal injury lawyer as soon as possible. They are trained professionals who can handle all negotiations with tact and ease. They can help you receive the best compensation for your claim in the shortest time frame possible. Give them a call today to know more.

Why Involvement in a Car Accident without License/Insurance Is Not the Worse?

Why Involvement in a Car Accident without License/Insurance Is Not the Worse?

line footer

Driving on the road is always a serious thing. To ensure that everyone around you is safe, you need a driver’s license. But what if you don’t have one and are caught by the highway patrol? Or worse, you get involved in a car crash for no fault of yours. Does not having a license automatically turns you into the guilty party?

Such a situation can be terrifying, infuriating, and nerve-racking for those not familiar with the law. But you mustn’t lose your calm just yet. The situation is not so bad even at that stage. Not owning a driving license is an offense, but it is not as severe as you believe. With the right legal help on your side, you can easily overcome this seemingly adverse situation.

Not only that, but a good car accident attorney can also help when you are involved in an accident without car insurance. Many states in the US follow a “no-fault” car insurance system which gives you a better chance of avoiding severe penalties. But this knowledge needs to be conveyed and every contingency needs to be covered by qualified legal help.

Driving on a Revoked License is Worse

People unfamiliar with the law might believe that defendants involved in accidents on a revoked license are in a better position than those who don’t have one. But that’s far from the truth just like other common misconceptions.

From a legal perspective, a person driving on a revoked license is flouting the law on purpose. Compared to this sheer disregard of the law, a person driving without a license is in a much better position to win the case.

Divert Focus on Accident and Let the Experts Handle the Missing License Problem

There can be ‘n’ number of reasons why you couldn’t obtain a license at the time of the accident, such as:
  • Lack of money
  • Lack of time
  • Missed out on the renewal date
These reasons can be explained and handled well by veteran lawyers. Do not worry about them and weaken the case. Whether you win or lose the case depends on the actual factors. Top lawyers know this fact. They focus exclusively on gathering evidence and reaching out to witnesses who can help you win.

Driving without Insurance

Just like the driver’s license, car insurance is also very important (arguably more important). If for some reason you are driving without insurance and get caught up in a car crash, you must call a personal injury lawyer ASAP.

Several mitigating factors can reduce the severity of the case against you.

People who belong to any of the 12 “no-fault” car insurance states in the US are in a better position. Even if you are at fault, you won’t be required to pay the damages through your insurance. According to the law in these states, the person who has suffered damages needs to contact his insurance company. Unless the damages are extreme, you can avoid serious punishments, especially if you have an experienced lawyer by your side.

Do not get into hasty settlements without seeking legal help. Many finer points can be exploited against you by the other party. Hiring the right car accident lawyer denver co is the way to go when you are missing car insurance.

The Right Legal Help is All you Need

The quality of legal help that you get plays a crucial role in determining the outcome of an accident case. While an aurora car accident attorney or lawyer will be calming in his demeanor, the bad ones will be jumpy and cause you to lose the case (in your mind) even before it starts.

Top lawyers understand that driving without a license and even insurance is not the worst thing. They will protect you from the negative influence and show you the right path.

Boating Accidents and What You Should Do

Now that we are officially in the summer months, boating is a fantastic way to cool off during a hot day. One can easily socially distance while boating and it is just a fun activity to partake in. Like most things, there are some rules we should be aware of and follow especially if involved in a boating accident.

According to the official Colorado Parks and Wildlife website, here are the steps to take in case you are involved in a boating accident.

  1. Stop at the scene and help others if, and only if, it can be done safely. This is required by the law.
  2. Do not risk lives to save any equipment. Call for help.
  3. Each operator involved in the accident must file an accident report. It is, again, required by law.
  • The information must be exchanged such as names, addresses, the vessel’s ID, and the name of the owner of the vessel if that is different from the person who was operating the said vessel.

         4.  An accident report form must be submitted within five days of the incident if:

  • Loss of life or someone disappears from the vessel
  • Injuries that require medical attention besides first aid
  • Damage resulting up to $2000 or complete loss of the vessel.

The address where to submit the report can be found on the official website for Colorado Parks and Wildlife.

Any person involved can be guilty of a misdemeanor if they fail to file a report.

The leading cause of boating accidents in Colorado is careless operation, excessive speed, and lack of attention. Leading causes of boat fatalities are capsizing and BUIs (boating under the influence).

As a reminder: Everyone on a vessel must wear an approved personal flotation device (life vest) and they should know how to use it.

As always, if you need representation regarding an accident like this, Boesen Law is more than happy to assist. Call us at (303) 999-9999.

Happy boating!

Self-Driving Cars: Convenient or Risky?

With the new decade upon us, technology is making more strides than ever before. Especially with automobiles, a new trend is emerging: self-driving cars. Companies like Tesla are reimagining what transportation can look like for individuals. While many people think of the convenience that comes with self-driving cars, a lot of questions remain regarding the safety of the technology.

Feasibility of Self-Driving Technology

While fully self-driving cars are still a long way away, it’s important to think about the safety of the technology. Car accidents involving a Tesla that was in self-driving mode have occurred, and rideshare company Uber has experienced issues with its self-driving cars. Many of the complaints about the technology stem from the idea that the technology used by these types of vehicles, doesn’t keep the driver of the vehicle engaged enough to take over in an emergency.

Who’s at Fault?

Another big question is on liability in car accidents. Today, individuals carry insurance that can go up or down depending on their driving history among other factors. With self-driving cars, it remains to be seen who can be held liable in the event of an incident. Can the individual who was hurt bring a claim against the auto manufacturer? The technology company that developed the software?

Where We Go from Here

While improvements to automobile technology continue, it is important to think about all potential benefits and risks that come with having a self-driving car. This development of technology could reshape the automobile and insurance industries for years to come.

Multiple Crashes Occur in Eagle County

[:en]Colorado Department of Transportation (CDOT) is urging people to take it while driving in the mountains. An article from ABC Denver 7 reports multiple collisions yesterday January 13, 2020, along I-70 in Eagle County.

Eagle County

The article states that authorities closed down exits near Vail and Dowd Junction briefly to deal with the accidents, however, they reopened in the afternoon. However, U.S. 6 heading toward Loveland was still closed at the time of reporting to deal with the situation.

Poor Conditions

Thanks to a heavy uptick in the snow in the mountains, driving conditions have been less than ideal. Eagle River Fire who responded to the crashes were reminding drivers to be aware of poor visibility and slick conditions, especially during evening hours. They also sent out a reminder to be cautious and to slow down and move over for any emergency responders.

Be Aware

A reporter for ABC Denver 7, Jayson Luber, has noted he regularly sees vehicles hitting first responder cars due to not moving over as required by law to make room for those attending to crash scenes. In response, first responder vehicles are now parked blocking multiple traffic lanes in order to shield those assisting individuals from oncoming traffic.
