US DOJ Launches Criminal Investigation Against J&J

The U.S. Department of Justice has announced they will be launching a criminal investigation into whether Johnson & Johnson lied about the safety of their talc products. 

Criminal Investigation to Begin

According to an article from Insurance Journal, Johnson & Johnson announced in February of 2019 that they had received subpoenas but did not say in regards to what. The investigation is being conducted by a grand jury in Washington that are going over the evidence. 

J&J In Hot Water

The company found themselves in the middle of controversy when internal company memos from the 1960’s and 1970’s were used as evidence in some of the multiple lawsuits the company has, that demonstrate scientists knew of asbestos in their talc presenting a “severe health hazard.” 

Other Lawsuits

Investors in the company are also upset, bringing lawsuits claiming that the company has defrauded them by not disclosing the risk that comes with using their talc products. In addition to these lawsuits, Johnson & Johnson face over 14,000 civil claims regarding the safety of their talc products.

Westminster Red Robin Closes After Individuals Diagnosed with E. Coli

A Red Robin restaurant in Westminster has been closed since Wednesday July 10th, 2019  after three individuals were diagnosed with E. Coli according to an article from 9 News

Children and Adults

According to the article, the current number of affected individuals are two children and one adult. The Tri-County Health Department is currently conducting an investigation and have already found several instances of improper food handling, cleaning, and safety measures. 

E. Coli Symptoms

The presence of E. Coli bacteria in someone’s system can begin to show up within one to 10 days of coming into contact with the bacteria. E. Coli symptoms include but are not limited to: Diarrhea, stomach pain, vomiting, and fever.

River Safety: Are You Prepared?

A favorite summer activity for many individuals is river rafting or tubing. Flying down the river can be an exhilarating feeling, or relax as you simply float on down the on a lazy river. However, with the added rain this season, rivers in Colorado have been rising at a swift rate. This can lead to serious injury and/or death if the proper precautions are not taken beforehand. 

Is the River Safe? 

Do not raft or tube in rivers where the height is nearly at the top of the bank, or overflowing. Furthermore check the rate of the current, if it’s moving too fast you could be swept downstream in an accident. Wear a Life Vest/Helmet

Make sure you are wearing a life vest and a helmet to protect you from injury in case you fall out of your raft/tube. Even if you consider yourself to be a strong swimmer, take the extra step and wear a life vest or personal flotation device for extra protection if you find yourself in the river – you could end up being swept downstream faster than you think. 

Use the Buddy System

Never attempt these activities alone. Go with a professional guide or have at least one other individual there to help you in case of an emergency. Ensure that you tell a friend of family member your expected return date, and if you are with a guide, listen carefully to the safety guidelines and to your guide’s instructions.

No Drugs or Alcohol

Do not engage in these activities under the influence of drugs and/or alcohol. These substances can impair and reduce your thinking and reaction time if an incident occurs.

Road Trip Tips: Are You Ready To Hit the Road?

There’s nothing quite like a summer roadtrip. Music, the open road, and maybe a couple of your family members or friends along for the ride. While it may be the last thing you want to think about, there is always a possibility for an accident to occur during your trip. Here are some tips to help you be prepared in case your trip hits a snag.

Tip 1: Roadside Assistance Kit

Check to see if your car has a roadside assistance kit. If not you can make your own by getting reflective triangles, jumper cables, flashlight, bandages, a rain poncho, quick tire inflation kit, and nonperishable food and water to keep on hand in case something happens.

Tip 2: Getting Help

Many auto insurance plans offer roadside assistance as part of their coverage. If you don’t have roadside assistance coverage with your plan, you can still call to get help, however you may be required to cover the entire cost. 

Tip 3: Check Before Hitting the Road

Do an inspection of your car before heading out on your trip to make sure it’s in good working order and up to handling the task of a long drive. Check your tire pressure and make sure fluids such as oil and washer fluid are at safe levels and get them topped off or changed if necessary beforehand.

Johnson & Johnson Motion Denied in OK Opioid Trial

An Oklahoma judge issued a ruling to dismiss a motion brought forth by the pharmaceutical company Johnson & Johnson on Monday July 9, 2019. The motion was a request to toss out a lawsuit filed by Oklahoma’s attorney general, which claims the company had a hand in creating the opioid epidemic. 

Johnson & Johnson Fight Back

The company argued that the lawsuit filed under a statute of public nuisance is incorrect, because the issue at hand does not meet the appropriate guidelines. According to an article from MSN, the state attorney general “was visibly angry as he repeatedly accused the company of lying.”

Trial to Proceed

However the effort was in vain, as judge Thad Balkman deemed that the state had presented enough evidence to allow the trial to go forward. The evidence is similar to evidence presented in lawsuits against Purdue Pharma, another pharmaceutical company being taken to task over the crisis. The attorney general laid out evidence that Johnson & Johnson downplayed the risk of opioids to medical professionals, used misleading data, and aggressively pushed using narcotics.

Police Officer Hurt in Accident at Dick’s Sporting Goods Park

An officer was injured yesterday July 4, 2019 while directing traffic for Independence Day festivities in Commerce City. 

Dick’s Sporting Goods Park

According to an article by ABC Denver Channel 7, the incident occurred at Dick’s Sporting Goods Park at around 6 p.m. before the start of a soccer match between the Colorado Rapids and the New England Revolution. The officer was knocked to the ground by a driver whom “was not paying attention to directions” according to a statement from another officer. 

Precautions Taken

The officer was taken to the hospital as a precaution and is believed to not have severe injuries at this time. Alcohol and drugs are not believed to be a factor in the incident, however police are currently conducting an investigation at this time and gathering more information.

It’s Lit: Firework Safety Tips

Independence Day is almost upon us and people are getting ready to celebrate. Whether that’s firing up the grill and having a cookout, attending a parade, or just spending quality time with family and friends. One important highlight of our nation’s holiday is our love of fireworks. While fireworks can produce beautiful and colorful displays, it is important to make sure you are practicing safe firework handling.

Keep Children and Yourself at a Safe Distance

Kids can get excited by the noise and colors that fireworks produce and may want to be as close as possible to the fireworks. However there is a possibility for burns and/or other injuries by being too close to a firework. Make sure there is enough distance between you and the fireworks.

Do Not Touch Fireworks that Do Not Go Off

Once in a while, you may get what is known as a “dud” where even when the firework is lit, it does not do anything. If this happens, do not pick up the firework. There is a possibility that the firework could still go off, and severely injure you or others in the process.

Do Not Hold Fireworks that are Lit

Just like with the tip above it is extremely dangerous to hold fireworks that are lit. There is an extreme risk of bodily injury and/or harm to you or others around you. When lighting fireworks, light them quickly and then move away to a safe distance.

Colorado AG Expands Purdue Pharma Lawsuit

Colorado Attorney General Phil Weiser has filed an expanded lawsuit against Purdue Pharma Denver’s ABC Channel 7 reported yesterday July 1, 2019.

Details Unknown

Due to a confidentiality agreement with Denver District Court, the details of the updated lawsuit are currently unknown at this time. However the attorney general’s office has asked the court to unseal the records due to a public issue they say is greater than any claims Purdue Pharma has regarding privacy. The original lawsuit was filed by former Attorney General Cynthia Coffman last year. 

Colorado Opioid Crisis

According to the article, data from the Colorado Department of Public Health and Environment show that 4500 Coloradoans died from an opioid overdose between the years of 2000 and 2018. Wesier commented that the updated lawsuit reflects claims that Purdue Pharma actively pushed data that was misleading, and aggressively pursued medical professionals to prescribe their developed drug known as OxyContin. Furthermore, the suit claims that the company had a list of Colorado medical providers who were known to often write prescriptions for opioids like OxyContin. They then pushed those providers to write even more prescriptions. 

Purdue Pharma Fights Back

A spokesman for the company stated that the company denies these claims and referenced the recent dismissal of a North Dakota lawsuit as possible proof the Colorado lawsuit will have the same fate.

Honda Issues Another Recall Over Takata Airbags

Honda is issuing another recall over the Takata airbags according to an article from USA Today.

1.6 Million Cars Recalled

The company announced the recall on Friday June 28th, 2019 which involves at least 1.6 million cars. Many of the cars who fall under the recall, are models ranging from the year 2003 all the way up until 2015. In addition to Honda, Acura models are also part of the recall.

Takata Airbag Dangers

The Takata airbags installed in many vehicles go even beyond just Honda and Acura cars. The airbags were found to be deploying shrapnel that could injure or kill the individuals driving the car when the airbags deployed, due to faulty inflators. Twenty-four people have died and many more have been injured as a result of the defective airbags.

Bankruptcy Problems

The Takata airbag problem has been so widespread that the company filed for bankruptcy in July of 2017.

A woman in California was recently awarded a $12 million dollar verdict in the latest lawsuit involving Johnson & Johnson and Colgate-Palmolive talcum products.

Mesothelioma Diagnosis

The 61-year old woman claims her frequent use of J&J talcum products such as Shower to Shower and Johnson & Johnson Baby Powder contain asbestos. She claims the asbestos is what led her to develop mesothelioma according to an article from Legal Scoops

Colgate-Palmolive Also Involved

This is one of the first cases where Colgate-Palmolive has been named as a defendant in these types of cases. The woman claims her use of Colgate’s Cashmere Bouquet product was also a factor in her diagnosis. Cashmere Bouquet was marketed as a type of talcum powder, however it was also manufactured as a soap product.

Johnson & Johnson still face over 13,000 pending lawsuits over claims their talcum powder causes individuals to develop mesothelioma and/or ovarian cancer with frequent use.
