Bayer AG who owns Monsanto Corp is considering a unique legal strategy in light of a $2 billion dollar verdict that was recently awarded to the plaintiffs of a Roundup lawsuit (get more info on the Roundup Lawsuit Verdict here). The plaintiffs brought the case against Monsanto Roundup after both were diagnosed with non-Hodgkin’s Lymphoma and claim Roundup caused their cancer.

Monsanto’s “Silver Bullet”

In what is known as the “silver bullet” defense, Bayer, owner of Monsanto Roundup, is reportedly planning to make an argument that this and other Roundup verdicts and lawsuits should be dismissed because “a U.S. regulatory agency said the herbicide is not a public health risk.”

This strategy gets its name from the idea that it is able to stop all other Roundup cancer claims from being considered.

A Risky Move by Bayer

Legal experts are doubting whether the strategy can work in appeals courts according to an article by Reuters.
