COVID-19 Vaccination Complications
As more and more Americans get vaccinated for COVID-19, we are beginning to see more reports regarding vaccine complications. On December 10, 2020, the U.S. Food and Drug Administration’s vaccine advisory panel issued a briefing document that found the severe complication/death rate for the Pfizer-Biotech COVID-19 vaccine to be 0.6 percent. On April 6, 2021, the European Medicines Agency (EMA) reported a link between AstraZeneca’s vaccine and rare blood clots in the brain.
While these complications are very rare, they can cause serious injury to those affected. Most people—including many personal injury lawyers—do not realize that the government has established a fund to compensate victims, as well as the families of victims, who suffer serious injury or wrongful deaths due to COVID-19 treatment and/or covered countermeasures, such as vaccination.

Who Is Entitled to Compensation for COVID-19 Vaccination Complications?
Under the Countermeasures Injury Compensation Program (CICP), which was created by the Public Readiness and Emergency Preparedness Act (PREP Act), the government can compensate people who suffer injuries caused by COVID-19 treatment and/or covered countermeasures. COVID-19 vaccines have been designated a “covered countermeasure” by the Secretary of the Department of Health and Human Services.
Therefore, if you were injured or if your loved one died due to COVID-19 treatment, vaccination, or another covered countermeasure, you could be entitled to compensation. Possible COVID-19 Vaccination Complications
COVID-19 vaccines are both safe and effective. The most common side effects are mild to moderate, and some people do not experience any side effects after their first dose, second dose, and/or booster.
According to the Centers for Disease Control and Prevention (CDC), the most common side effects associated with COVID-19 vaccination include:
- Pain, redness, and/or swelling at the injection site
- Headache
- Tiredness/fatigue
- Chills
- Fever
- Muscle pain/aches
- Nausea
These side effects are typically mild and generally go away on their own after several hours or days. While allergic reactions are rare, they can occur. Anyone who has an allergic reaction to a COVID-19 vaccine should seek medical attention and refrain from receiving any further doses of the same vaccine.
While adverse reactions to the COVID-19 vaccine are rare, they have been reported. According to the CDC, the most common adverse COVID-19 vaccination complications include:
- Anaphylaxis: Severe allergic reaction
- Thrombosis/thrombocytopenia syndrome (TTS): Blood clots; associated with the Johnson & Johnson (J&J) COVID-19 vaccine
- Guillain-Barré Syndrome (GBS): A rare disorder in which the immune system attacks nerve cells, causing damage; associated with the J&J COVID-19 vaccine
- Myocarditis: Inflammation of the heart muscle
- Pericarditis: Inflammation of the heart’s outer lining
- Death: Healthcare providers are required to report any deaths occurring after COVID-19 vaccination, regardless of whether it is known if vaccination was a factor or cause of death
What Compensation Is Available for Victims of COVID-19 Vaccination Complications?
Victims injured by a COVID-19 vaccine may be eligible to receive reimbursement of up to $50,000 in unreimbursed lost wages, as well as reimbursement for out-of-pocket medical expenses. CICP also provides a death benefit in cases where the COVID-19 vaccine causes death.
For the fiscal year 2021, the death benefit for designated surviving family members of those who have died due to the COVID-19 vaccine is $370,376.
How to Request Reimbursement for COVID-19 Vaccine Injuries
A “Request for Benefits” for vaccine-related injury or death must be made to the CICP within one year after receiving the vaccine. Requests for Benefits filed after that one-year cutoff date will NOT be considered for CICP benefits.
In order to complete a medical review for eligibility, the CICP requires the claimant to provide a complete copy of all medical records related to the injury, or death, as well as all medical records from one year before the receipt vaccine.
