Boesen Law Covid 19 Vaccination complication
As more, and more, Americans get vaccinated for COVID-19, news about vaccine complications are beginning to be reported. This is a page dedicated to Covid 19 Vaccination Complications and will be updated regularly.
On December 10, 2020, the U.S. Food and Drug Administration’s vaccine advisory panel issued a briefing document that finds that the severe complication/death, rate for the Pfizer-Biontech COVID-19 vaccine is .6%; and, on April 6, 2021, the European Medicines Agency (EMA) is reporting a clear link between AstraZeneca’s vaccine and rare blood clots in the brain.
Many people – including most personal injury lawyers – do not know it, but the government does have an established fund to compensate victims, and the families of victims, who suffer serious injury, or killed, due to COVID-19 treatment/covered countermeasures.
Under the Countermeasures Injury Compensation Program (“CICP”), which was created by the Public Readiness and Emergency Preparedness Act (“PREP Act”), the government can compensate people who suffer injuries caused by COVID-19 treatment/covered countermeasures. COVID-19 vaccines have been designated a “covered countermeasure” by the Secretary of the Department of Health and Human Services.
Complications from a Covid-19 Vaccination
Victims injured by a COVID-19 vaccine may be eligible to receive reimbursement of up to $50,000 in unreimbursed lost wages, as well as reimbursement for out-of-pocket medical expenses. CICP also provides a death benefit in cases where the COVID-19 vaccine causes death. For the Fiscal Year 2021, the death benefit for designated surviving family members of those who have died due to the COVID-19 vaccine is $370,376.
A “Request for Benefits” for vaccine-related injury or death must be made to the CICP within one (1) year after receiving the vaccine. Requests for Benefits filed after that one year cut-off date will NOT be considered for CICP benefits.
In order complete a medical review for eligibility, the CICP requires the claimant to provide a complete copy of all medical records related to the injury, or death, as well as all medical records from one year prior to the receipt vaccine.
