Plaintiffs Fight Back Over J&J Talc Case Movement

Some talcum powder plaintiffs fighting with Johnson & Johnson over the safety of their talcum products, are taking a stance over cases being moved from state to federal court.

Imerys Talc Bankruptcy

After Johnson & Johnson’s (J & J) talc supplier Imerys Talc America filed for Chapter 11 bankruptcy earlier this year, J&J asked for cases to be heard in federal court in Delaware which is where the bankruptcy case for Imerys Talc is taking place.

Talc Plaintiffs Fight Back

Lawyers for plaintiffs however are pushing back, stating that there is no federal interest in these cases that would require switching courts.

Johnson & Johnson’s additional request for expedited review and relief was rejected by the federal court in Delaware due to it being Johnson & Johnson’s choice to transfer the cases according to a Law.com article.

Talc Claims Nationwide

Despite trying to move to federal court, Johnson & Johnson is still facing over 13,000 pending claims that the use of their talc products caused individuals to be diagnosed with ovarian cancer and other serious medical problems.
